Will and Healthcare Power of Attorney

By preparation, you can be sure that your healthcare preferences are respected in the event of a catastrophe, and that your wishes are taken care of in the event of your death.  A Last Will and Testament is a legal document that says what happens to the assets and debts of your estate after your death.  Without a Will, a person’s estate passes through a default method known as intestate succession.  To address healthcare decisions, a Healthcare Power of Attorney or Living Will allow you to specify how you would like your healthcare handled in the event that you become incapacitated.

Durable Power of Attorney

A Power of Attorney is a signed document that allows a person to act on behalf of another person.  Such documents are useful for a variety of situations, but particularly for situations where a party becomes incapacitated.

Probate

Upon the death of an individual, the law requires the Probate Court to determine the disposition of that person’s estate.  This process can be done in a number of ways depending on the size and make-up of the estate and whether the person left a Will.  The process often includes filing various documents with the Probate Court to account for the contents of the estate, and then a final distribution.
